President Bola Tinubu has asked Nigeria’s Senate to amend the transfer of convicted offenders bill to allow Nigeria to make prisoner transfer agreements with any foreign country, not just Commonwealth nations.

The proposed bill, known as the Transfer of Convicted Offenders Enactment and Enforcement Amendment Bill, would allow eligible Nigerians serving prison sentences abroad to return home and complete their sentences in Nigeria. It would also allow foreign citizens convicted in Nigeria to return to their home countries to serve their prison terms.

Under the current law, Nigeria’s prisoner transfer agreements are mainly limited to Commonwealth countries. The proposed amendment seeks to expand this arrangement by allowing the government to reach similar agreements with other countries.

Under the bill, the President would be able to approve these agreements through an order published in the Federal Gazette, provided the countries involved have reached a mutual agreement.

Supporters say prisoner transfers can help inmates overcome language and cultural barriers. They can also allow prisoners to serve their sentences closer to their families and make prison management easier for the countries involved.

The Senate has referred President Tinubu’s proposed transfer of convicted offenders bill to the Senate Committee on Rules and Business for further review. The committee is expected to gather expert opinions and prepare a report. The bill must pass the required legislative stages and receive presidential approval before becoming law.

Some people believe the proposed amendment could help Nigerians serving prison sentences abroad by allowing them to serve the remainder of their sentences closer to home and their families.

However, others are concerned that wealthy or well-connected prisoners could benefit more than ordinary citizens. These concerns have raised questions about fairness, transparency and equal treatment under the law.
